The Pacific Legal Foundation has filed a lawsuit challenging the constitutionality of AB 32 (CA’s Global Warming Law).  Those of us familiar with AB 32 know the significant negative impacts its implementation have and will cause the California business climate.  The last opportunity we have to stop its implementation is to succeed in court.   With this in mind, UnitedAG is hosting Pacific Legal Foundation (PLF) for a luncheon briefing regarding the status of the lawsuit.  The luncheon will be from September 10th from 11:00 am to 1:30 pm in Santa Maria at the Radisson Hotel located at the Santa Maria Airport.  You will not want to miss this briefing.  I would recommend you RSVP today. on AB 32 LawsuitWe Need to Hold CARB’s (California Air Resources Board) Feet to the Fire!
The massive new taxes collected under California’s cap and trade auction present significant costs and consequences to businesses and consumers across the state. The biggest problem with the California Air Resources Board’s auction regulation is the taxes were created in violation of the California Constitution, so Pacific Legal Foundation sued.
 
It’s important to head off this regulatory train wreck before it destroys jobs, agricultural businesses, and our state’s economy.
 
Hosted by UnitedAg, Pacific Legal Foundation is holding a briefing in Santa Maria, for farmers, ranchers, and other business owners. This 90-minute briefing includes presentations by PLF attorneys Ted Hadzi-Antich and Tony Francois. In addition to information about the AB 32 lawsuit, you will hear updates on other important PLF cases related to water rights and overreaching environmental regulations.Pacific Legal Foundation represents a broad spectrum of California businesses, trade associations, and individuals harmed by the regulation. Their lawsuit challenges the auction process as an unconstitutional state tax because it was not enacted by two-thirds majorities in both chambers of the Legislature, as required for new taxes by the California Constitution (Proposition 13 and Proposition 26).

As PLF’s complaint states, the California Air Resources Board (CARB) devised the auction plan as a means of raising billions of dollars in revenue, without any instruction or direction from the Legislature. We need to hold CARB’s feet to the fire! We must hold regulators accountable to the Constitution.
