    Attempted Murder in Ventura | Arrest Made with help of K9 Officer

    Ventura Police Department – Incident Press Release

    On March 25th at 4:28 AM, patrol officers responded to report of a shooting in the area of the 400 block of East Santa Clara Street. When the first officer arrived on scene, he found the suspect hiding near a planter on Santa Clara Street near California Street. As the officer made contact with him, the suspect was initially uncooperative, and he threw a handgun into nearby bushes.  Additional officers arrived and assisted with detaining the suspect.  The weapon was recovered.

    The subsequent investigation revealed this was a robbery.  The suspect had approached two vagrants living nearby, pulled a gun and demanded their property.  While he was committing the robbery, a “good Samaritan” heard the commotion and not knowing it was a robbery, attempted to intervene.  When he intervened, the suspect turned towards him with the gun and chased him into a nearby vehicle.  The suspect began beating his fist on the window and fired 3 rounds at the “good Samaritan”.  All three rounds hit the vehicle but none of them struck the victim. After firing the initial 3 rounds, the suspect then turned and fired 2 additional rounds that struck a nearby commercial building.  The commercial building was uninhabited.  After firing the rounds, the suspect fled on foot and was contacted by officers.

    At the conclusion of the investigation, the suspect was arrested for attempted murder, assault with a deadly weapon, armed robbery, shooting at an occupied vehicle and shooting at an uninhabited building. No one was injured during this incident.

    Moorpark: Known Gang Member arrested for Alleged Possession of Loaded Handgun

    On March 24, 2019, at about 5:12 PM, a traffic stop was conducted by the Moorpark Police Department on a 2005 Chevrolet Tahoe on Tierra Rejada Road, near State Route 23, for vehicle equipment violations.

    At the time of the traffic stop, the deputy identified the driver as Nicholas Lerma, a known and documented gang member residing in the City of Moorpark. Lerma displayed signs and symptoms of being under the influence of one or more controlled substances.

    During the course of the investigation, a search of Lerma’s vehicle revealed a loaded silver handgun concealed in a trunk compartment of the vehicle.

    Lerma was arrested for California Health and Safety Code 11550(e) – Under The Influence With a Firearm; California Penal Code 25400(a)(1) – Carry a Concealed Firearm Within a Vehicle; California Penal Code 25850(c)(6) – Carry a Loaded Unregistered Firearm and California Penal Code Section 186.22(a) – Participation in a Criminal Street Gang.

    Lerma was booked into the East Valley Jail where he is currently being held in lieu of $200,000.00 bail. His court date is pending.

    Overnight Closures on State Route 126 in Fillmore, Ventura and Santa Paula for Construction Activities

    VENTURA, SANTA PAULA, FILLMORE – The California Department of Transportation (Caltrans) announced planned closures on State Route 126 (SR-126) for striping and guardrail work in the cities of Fillmore, Ventura and Santa Paula and the unincorporated area of Piru.

    From Monday, March 25 to Friday, March 29, the following planned closures of SR-126 are scheduled between 9 p.m. to 6 a.m.:

     

    Westbound:

     

    • One lane from to the Los Angeles-Ventura County line to El Dorado Drive in the city of Fillmore. (7 p.m. – 6 a.m.)  
    • One lane from Hallock Dr. in Santa Paula to US 101 in Ventura.

     

    Eastbound:

     

    • One lane from US 101 to Hallock Dr in Santa Paula.
    • Main St. off-ramp
    • Victoria Ave on and off-ramp
    • Kimball Rd. on and off-ramp
    • Wells Rd. on-ramp and off-ramp
    • Briggs Rd. on-ramp and off-ramp
    • Tenth St. on-ramp.

     

    Closures may start and end later. All closures are weather permitting and subject to change. No two consecutive on and off-ramps will be closed at the same time. 

    Motorists should expect delays and are strongly advised to use alternate routes or avoid the area. Additionally, motorists can check traffic conditions before they leave by visiting the Caltrans Quickmap.

    The closures are part of two road paving projects on SR-126 that stretches from US-101 to Los Angeles-Ventura County line. C.A. Rasmussen Inc. of Valencia, CA and Granite Construction Co. of Santa Barbara, CA are the contractors for the projects.

    Caltrans reminds drivers to be “Work Zone Alert” and to “Slow for the Cone Zone.”

    Alabama Parts Ways With Avery Johnson

    Alabama has officially decided to “mutually part ways” with head basketball coach Avery Johnson.

    The Crimson Tide announced its decision in a press release on Sunday. Johnson had been Alabama’s coach for four years, and finished his career with a record of 75-62. (RELATED: Avery Johnson Could Be Out At Alabama, Says Report)

    “After meeting with Coach Johnson, we made the decision to mutually part ways,”  Alabama Athletic Director Greg Byrne said. “This was not an easy decision, and we thank him for his contributions over the past four seasons. We wish Coach Johnson and his family the very best.”

    Johnson handled his departure with the same class that he displayed over his four years at Alabama. (RELATED: Nick Saban And Bill Belichick Photographed Together At Alabama’s Pro Day)

    “This was an opportunity of a lifetime, and we truly enjoyed our experience at Alabama,” Johnson said.  “I also want to thank my family for all of their support and contributions to the program.”

    I had the opportunity to meet Coach Johnson a few years ago when I was a student. He’s a class act and a good basketball coach, but he couldn’t get the program over the hump. Best of luck to him and his family.

    The question now becomes who Alabama hires next. We have an incredibly talented roster returning, and a good recruiting class. This is clearly one of the best open jobs in the country right now, but Alabama has to get this hire right.

    Many fans are going to want the Crimson Tide to look at Rick Pitino, but that seems unlikely given all of his baggage. Alabama alum Steve Prohm has been solid at Iowa State, although he appeared to deny interest in the job.

    Regardless of who Alabama hires, it’s time for this program to finally start living up to its potential. Alabama basketball is a sleeping giant, but it has to wake up now.

    It’s now or never.

    Ask God to have mercy on us as a nation…if you want freedom to survive”

    NEWBURY PARK—“If you want freedom to survive for your children and your grandchildren, it  has to begin here—thanking God on your knees—asking God to have mercy on us as a nation,” said Rick Green at the Red, White, Blue & Green event hosted Saturday by Godspeak Calvary Chapel and live streamed nationwide.  “All these Patriots have passed the torch of freedom.  We can not fumble it.  This torch can not be dimly let; but let us do our part by taking a stand.  Freedom is not free.  We must protect freedom and pass it on to the next generation.  The choice is ours.  What will we do on our watch?”

    Some 200 attendees were challenged by Michael Hernandez  a former Texas State Representative (1999-2003) and the founder of Patriot Academy (which trains those 16-25 to change the world) to “become informed citizens” by studying the Declaration of Independence, the Constitution (Constitution Alilve), the Founder’s Bible (featuring articles written by historian David Barton, founder of Wallbuilders) and by voting for candidates.   A challenge was given by Green to “join in training the next generation of leaders to understand freedom.”

    Green’s son, Rhett, spoke about the four basic and extraordinary principles that our founding documents teach us today:

    • Our founding fathers believed that truth is real;
    • God is the source of our freedom and our rights come from God Almighty;
    • Just powers can only come from the consent of the governed (mentioned three times in the Declaration of Independence and 11 times in the Constitution); and
    • We are the most successful nation in history because our free enterprise system allows us to pursue happiness.

    “We all have a part to play in preserving these four basic and extraordinary principles.  What will you do?

    Audience members were told:

    • 37 percent of American cannot name a single freedom out of the First Amendment;
    • 74 percent of American cannot name the three branches of government (this was 62 percent just seven years ago;)
    • 95 percent of our nation’s founders were outspoken Christians.

    Kamryn, Green’s 18-year-old daughter, spoke on Sybil Ludington’s Midnight Ride to alert the militia forces in the villages of Putnam County, New York and Danbury, Connecticut to the approach of the British regular forces on the night of April 26, 1777.   The 16-year old girl rode twice the distance of the famous Paul Revere account in April, 1775.

    “Let’s remember that for every Paul Revere, there are thousand of unlikely heroes who will step up and protect lives.  One ordinary person can decide to rise up to an extraordinary call,” said Kamryn.  “There is a call on your life, a purpose greater than yourself.   You have a sphere of influence to make a difference.   He (the Lord) is our strength.  He can light our path just like Sybil’s.  No matter your age.  (You) can make a difference where God has placed you.”

    Green spoke on American exceptionalism.    “We saved the world three times this last century—from Nazism; Communism; and Despotism.   We are the only people who have had a technological advantage in war and not used it for conquest.  What we do is take our money and rebuild nations that have attacked us.”

    According to Green, The Declaration of Independence is the frame of America.  This frame holds everything together.   As free citizens, we have a duty to protect, restore and preserve that frame of freedom.”

    The night was captivated by quotes from President Ronald Reagan and the American founders, as well as songs from the Green children.  “Of the many influences that have shaped the United States of America into a distinctive nation and people,” said President Reagan “none were more enduring and fundamental than the Bible.  It’s teaching helped form the basis for the founding fathers abiding beliefs…and a rendezvous with destiny.”

    • George Washington: “Of all habits, religion and morality are indispensable supports.” 
    • James Wilson: “Human law must rest its authority ultimately upon the authority of that law that is divine.  Far from being rivals or enemies…religion and law are twin sisters, friends and mutual assistants.  Indeed, these two run into each other.”
    • Gouverneur Morris: “Religion is the only solid basis of good morals.  Therefore, education should teach the precepts of religion and the duties of man toward God.”
    • Benjamin Rush: “My only hope of salvation is in the infinite transcendent love of God manifest to the world by the death of His Son.”
    • Benjamin Franklin: “God governs the affairs of men…Prayer implores the assistance of heaven.”
    • Thomas Jefferson: “Can the liberties of a nation be secure when we have removed their only firm basis…that these liberties are the gift of God.”
    • John Quincy Adams: “Duty is ours, result is God’s.”
    • President James Garfield; “Now more than ever before, the people are responsible for the character of their Congress.  If that body is ignorant, reckless, and corrupt, it is because of the people.

    The patriotic night featured the First and Second Amendments as well as observations made by President George Washington in his Farewell Address when he noted the difference between the American and French revolutions—was that in America, God was not left out.  “If you want freedom, you need God,” said Green who also spoke out against socialism and the false narrative that the founders were “slave holders” wanting to uphold slavery.  “Yet, three-fourths of the founders were abolitionists.”

    Green concluded the evening by asking:  “Are you willing to pledge your life, your fortune and your sacred honor for America?  America depends on the restoration of constitutional principles.  It depends on ‘we the people.’  In fact, the fate of the free world depends on us.  It’s time to do something.”

    Opposition Rally to Rep. Omar’s Keynote for CAIR – Woodland Hills

    If it bleeds it leads, an old maxim in journalism.  Many outlets have reported that hundreds protested freshman congresswoman Illhan Omar’s Keynote speaking event at the Hilton Hotel in Woodland Hills CA. Further, some made it appear combative, where eyewitness accounts gave testament to a large number of well behaved supporters for the United States and Israel. An example of this didn’t even come from a left leaning publication but from the Washington Times: Hundreds protest outside Ilhan Omar CAIR speech., The lead photo shows an isolated confrontation.

    The event being protested was a fundraiser for CAIR, the Council on American-Islamic Relations, an organization that has garnered its own criticism. Most recently the group has attempted to push hosts Judge Jeanie Pirro and Tucker Carlson off of the FOX lineup.  Pirro was suspended for two weeks for comments that were “perceived” as anti-Islamic.  The comments were given by the Judge Pirro, a former District Attorney, after Omar escaped censurer in the House of Representative where she serves for what many saw as anti-Semitic/anti-Israeli.  The House instead of singling out Omar condemned all hate speech.

    Please keep in mind that Woodland Hills is a heavily Jewish district, and Brad Sherman, who represents the area in Congress, expressed his disagreement/displeasure over Omar’s tweets and comments regarding Israel. 

    Many who attended the protest wore the Yellow Star of David that was forced on the Jews in Nazi occupied territory, people who were marked for extermination.  

    FOX was one of the outlets that underestimated the size of the crowd of protesters, Rep. Ilhan Omar faces hundreds of protesters outside CAIR fundraiser in California. Once again, photographer, Marc Langsam, gives validity to the claim there were close to one thousand opponents to Omar and CAIR gathered on the sidewalks opposite the Hilton Hotel.

    Governor Newsom’s moratorium on the death penalty

    Governor Gavin Newsom’s recent executive order declaring a moratorium on the death penalty is a test of the boundaries of executive privilege. California Constitution Article 5, Section 1 states, “The supreme executive power of this State is vested in the Governor. The Governor shall see that the law is faithfully enforced.” But does the governor have the authority not to enforce laws?
    .
    The governor’s moratorium consists of three provisions. The first is a reprieve for all currently condemned inmates. Although the language of the written order does not include the word “temporary,” the governor represented in his comments that he intends the reprieve to be for the term of his office. The second provision of the governor’s order is to repeal California’s lethal injection protocol. The third provision is the immediate closure of the execution chamber at San Quentin (the order refers to it as the “death chamber”).

    California Constitution Article 5 Section 8 grants the governor nearly unlimited authority to issue reprieves, pardons and commutations of sentenced persons. Using his constitutional authority, the governor could have taken more drastic measures. He could have made permanent and irrevocable orders of commutation or clemency for every person on death row. He could even have granted full pardons. But there are some limits to his authority. The governor cannot prospectively issue reprieves or pardons in future cases, so prosecutors are still able to pursue death sentences in court. To pardon or commute the sentence of a person who has two or more felony convictions, the governor requires a majority recommendation from the Supreme Court.

    The governor’s orders to “close” the execution chamber and repeal the execution protocol are more legally problematic. Nearly all currently effective death penalty statutes were enacted via ballot initiative, most recently by Proposition 66 in the 2016 election. Any change to those laws, which were enacted by voters, require more than a simple majority vote of the legislature or executive order. The language of each initiative generally calls for at least a two-thirds majority vote of the Legislature or a new ballot initiative. An amendment to Proposition 66 requires a three-fourths vote of the Legislature.

    Proposition 66 added subsection (e) to Section 3604 of the Penal Code. That subsection requires the California Department of Corrections and Rehabilitation to “maintain at all times the ability to execute such judgments.” The governor’s orders to repeal the execution protocol and “close” the execution chamber are in direct contradiction of that law.
    Proposition 66 also provided broad standing for sentencing courts, district attorneys and victims of crime to enforce this provision. It added Penal Code Section 3604.1 which provides in subdivision (c), “If the Department [of Corrections and Rehabilitation] fails to perform any duty needed to enable it to execute a judgement, the court which rendered the judgement of death shall order it to perform that duty on its own motion, on motion of the District Attorney or Attorney General, or on motion of any victim of the crime as defined in article I, section 28, subdivision (c) of the Constitution.”

    Realistically, the governor’s second two orders are without practical effect given the first order. “Closing” the execution chamber means what? Taking a gurney out of a room that has windows for viewing? Disassembling the unused gas chamber for a method of execution that the state no longer uses? Unless the governor directs the Department of Corrections and Rehabilitation to tear down the entire building in which the execution chamber is contained, the execution chamber remains there as a room with windows. As for “repealing” the lethal injection protocol, the protocol is a regulation memorialized in writing that describes all the steps to be taken to perform an execution. It is a document that has been publicly published on the internet. “Repealing” it is without practical effect when the document is readily available and can just as quickly be reinstated as a regulation. This is particularly true now that the execution protocol is, due to Proposition 66, exempt from the public commentary requirements of the Administrative Procedures Act.

    If the second and third items of the governor’s executive order are, as some have argued, within the governor’s authority, then the governor has absolute authority to declare or invalidate any law by executive order. He could, for example, unilaterally outlaw paper towels.
    .
    The concerns the governor articulated about the death penalty have long been part of the debate over capital punishment. But those issues were part of the public debate that occurred during the 2012 and 2016 elections. The voters weighed those considerations and chose to keep the death penalty. Prior to being elected, Gov. Newsom promised that although he does not support the death penalty, he would not interfere with the will of the voters. He has violated that promise by issuing an executive order that usurped the legislative authority of the voters.
    .
    This assertion of executive authority is particularly ironic following Gov. Newsom’s announcement along with Attorney General Xavier Becerra last month that California would be leading a lawsuit challenging the president’s executive order declaring a state of emergency. The argument presented in the lawsuit is that the president’s use of this executive authority usurps congressional authority to appropriate funds. How is this moratorium by the governor which usurps the legislative authority of the voters to enact laws via ballot initiative any different?
