    A New Approach to Pension Reform Goes to Appellate Court

    2

    By Edward Ring

    The recent ruling by the California Supreme Court in the case CalFire vs CalPERS has garnered much attention from pension reformers. While falling short of being a landmark ruling, the result was nonetheless encouraging. The court left open the possibility that vesting does not protect prospective benefits of current employees. The implications of that are left to related, still active court cases to decide.

    Meanwhile, a completely different approach to pension reform has been hitting courts around California, centered on the argument that government agencies did not follow due process when approving pension enhancements. Between 1999 and 2007, one by one, nearly all of California’s government agencies enacted pension benefit increases of 50 percent or more. These increases were made retroactively, causing an actual financial impact well in excess of 50 percent. But when they did this, did they obey the law?

    Three lawsuits have been filed by citizen taxpayers seeking to have pension increases overturned on the ground that they were adopted in violation of Section 7507, but each time, the trial court has dismissed the case on the ground that the lawsuit is barred by the three-year statute of limitations.

    Convinced that the statute of limitations should not act as a bar to taxpayer claims to challenge these statutory violations, taxpayer/plaintiff George Luke raised the money to hire counsel, Robinson & Robinson LLP, to take an appeal from the statute of limitations ruling.  If Mr. Luke is successful, it will open the door to every agency, or their taxpayers, where pension increases were approved without complying with Section 7507 to either challenge those pension increases in court or to renegotiate them. The brief on appeal in the Luke case is available here.

    The legal challenge claiming pension benefit enhancements were adopted without following due process is based on California Government Code Section 7507, which prohibits adoption of retirement benefit plan increases unless the approving agency first (1) retains an enrolled actuary, (2) who prepares an actuarial report, (3) which estimates future costs of the increases, and (4) the estimate of future costs are made available to the public at a meeting at least two weeks before the agency approves the increases. It is not clear that any of the several cities and counties that have been audited so far had complied with these requirements.

    Local pension reform activists in California, along with local elected officials committed to pension reform, can request and copy archives from local agencies that documented the process they followed when they enhanced their pension benefits. That audit process can be summarized as follows:

    (1) Find out whether your agency approved pension increases between 1999 and 2007.

    (2) If so, obtain all documents pertaining to that approval as described below and ascertain whether the documents show compliance with Government Code Section 7507.

    (3) If the documents do not reveal compliance, preserve copies of those documents. They will be important evidence if there is future litigation involving the pension increases.

    (4) Contact the agency’s attorney to inform him or her of the non-compliance.

    The California Policy Center has compiled a detailed set of instructions to assist elected officials, candidates, and taxpayers to determine whether their city or county pension system complied with the 7507 requirement when major increases in pension formulas were made between 1999 and 2007. That information can be found here.

    California’s public employee pension systems are facing financial headwinds of growing strength. As of March 9th, America’s bull market in equities has lasted a record ten years. During the same time there has been a runup in real estate values that far exceeded the rate of inflation and is unsustainable. The long overdue rise in interest rates threatens the bond market. And yet, here on the tail end of one of the best decades for investors in history, California’s pension systems are only about 70 percent funded. When the markets slump, pension headwinds will turn into pension hurricanes.

    To save pensions, it is a false choice to only offer tax increases and service cuts. Measured reductions to pension benefits accruals for future work – not even touching pension benefits already earned – will be an essential element of any successful strategy. Accomplishing this in court, when the politicians lack the will to do what must be done, may be the only avenue possible. George Luke’s appeal offers another path forward.

    Notes on Brexit

    By Jim Sullivan

    Brexit has been preying on my mind as another incredibly stupid piece of politics for a while now, so I have put down some facts and ideas on that topic in the following note:

    The European Union (EU), which started out in 1957 as the European Coal and Steel Community, was created primarily to reduce the reasons for warfare between European countries through economic cooperation, and has succeeded admirably (though not perfectly) in that respect.  The wars that tore Europe apart in the 20th century testify darkly to the importance of the EU.  So I think Brexit is a colossal bad idea in that it would reduce economic cooperation and raise immigration barriers between the U.K. and the rest of Europe.  By reducing cooperation between themselves and Europe, the U.K. could well increase the chance of war between them.  And if the U.K. exits Europe, other states may think that an attractive precedent and will surely find things they don’t like about their membership in the EU (no institution is perfect) and vote for leaving too.

    There are a number of theses about what caused the Brexit movement in the U.K.  Suffice to say they are many and varied.  The fact remains, however, that the Conservative Party of the U.K. established the legal basis for a referendum on EU membership through the European Union Referendum Act of 2015.  The referendum itself occurred in June of 2016 and the so-called “leavers” (those in favor of Brexit) won with 51.9% of the vote.  And in 2017 a conservative, Theresa May, though originally against leaving the EU, triggered Article 50 of the Lisbon Treaty, which was required for the split to take place within two years.

    Conservatives thus brought about the undermining of a most fundamental economic and political institution, seemingly forgetting the raison d’etre of the EU.  Whatever the real reason for Brexit, it cannot outweigh the many advantages conferred by membership in the EU.  The Conservative Party did their country and Europe a major, if not destructive, disservice by passing the European Union Referendum Act of 2015, calling the 2016 Brexit referendum and triggering Article 50 of the Lisbon Treaty in 2017.

    What’s the matter with conservatives?

    5 Celebrities Speaking Out Against Abortion

    5 Celebrities Speaking Out Against Abortion

    By Tess Farrand, Movieguide Staff Writer

    For you created my inmost being; you knit me together in my mother’s womb. I praise you because I am fearfully and wonderfully made; your works are wonderful, know that full well.” – Psalm 139:13-14 (NIV)

    If you turn the news at any point in the day, chances are you’ll see abortion as a major point of political and social contention. In the midst of such a polarizing time, many Christians in Hollywood are speaking out about their pro-life beliefs and are encouraging others to get involved…

    1. Kevin Sorbo (pictured above)

    Earlier this year, Kevin Sorbo explained his pro-life stance on Fox News, stating, “it’s incredible to me just how far this country has fallen into such a weird, weird space. It’s really sad.” The actor went on to note that he does many pro-life speaking events around the country where he’s seen the lives of pregnant women transformed by the technology of sonograms. Sorbo highlighted that 80% of women choose to carry their babies to term rather than abort them because of hearing their heartbeat. At 22 days, there’s a heartbeat, if that’s not a life, then tell me what it is.”

    1. Patricia Heaton

    Actress Patricia Heaton is no stranger to speaking out against abortion on social media. In January, when the New York Governor signed a bill allowing late-term abortion, Heaton expressed her views on Twitter. “Everything Kermit Gosnell was arrested, convicted and jailed for is now legal in New York – except in New York you don’t even have to be a doctor. Nice work @NYGovCuomo.”

    1. Kirk Cameron

    On a recent interview on FOX AND FRIENDS, actor Kirk Cameron reflected on his own family when asked how he feels about abortion. “I sit back as a father of six kids, and I wonder ‘how did we even get to this place in a nation like ours?’” He continued, “it’s personal to me because my wife is an adopted child.” Cameron and his wife Chelsea recently celebrated their 28th wedding anniversary and are themselves the parents of six children, four of whom are adopted. Cameron concluded, “my whole family is here because of people who helped these girls at a critical moment choose life for their babies, and I’m so grateful.”

    1. Kelsey Grammer

    The CHEERS actor, who has won five Primetime Emmy Awards and three Golden Globes posted a picture of himself on Instagram wearing a t-shirt that bears an image of a gun, and a provocative question, “Would it bother us more if they used guns?” Underneath the question the pro-life website abort73.com is listed.

    1. Ashley Bratcher

    Ashley Bratcher might be unfamiliar for now, but that won’t be so for long. The actress stars in the upcoming faith-based movie UNPLANNED, which follows the true-life story of Abby Johnson, a Planned Parenthood manager turned Christian and pro-life activist. While filming UNPLANNED, Bratcher learned that she was almost aborted when her mother was pregnant, making the message of the movie very personal to her.

    Interview with a Retired Vaccine Researcher

    2

    Dr. Mark Randall is the pseudonym of a vaccine researcher who worked for many years in the labs of major pharmaceutical houses and the US government’s National Institutes of Health.

    Mark retired in the 1990s. He says he was “disgusted with what he discovered about vaccines.”

    As you know, since the beginning of NoMoreFakeNews, I continue to launch attacks against non-scientific and dangerous assertions about the safety and efficacy of vaccines.

    Mark was one of my early sources.

    At the time this interview was originally published — in January 2002, Mark was a little reluctant to speak out, even under the cover of anonymity. But, with the push to make vaccines mandatory and with penalties like quarantine lurking in the wings (even back then), he decided to break his silence.

    Like many of my sources, he developed a conscience about his former work. Mark was well aware of the scope of the medical cartel and its goals of depopulation, mind control, and general debilitation of populations.

    ~~~
    Q: You were once certain that vaccines were the hallmark of good medicine.
    A: Yes I was. I helped develop a few vaccines. I won’t say which ones.
    Q: Why not?
    A: I want to preserve my privacy.
    Q: So you think you could have problems if you came out into the open?
    A: I believe I could lose my pension.
    Q: On what grounds?
    A: The grounds don’t matter. These people have ways of causing you problems, when you were once part of the Club. I know one or two people who were put under surveillance, who were harassed.
    Q: Harassed by whom?
    A: The FBI.
    Q: Really?
    A: Sure. The FBI used other pretexts. And the IRS can come calling too.
    Q: So much for free speech.
    A: I was “part of the inner circle.” If now I began to name names and make specific accusations against researchers, I could be in a world of trouble.
    Q: What is at the bottom of these efforts at harassment?
    A: Vaccines are the last defense of modern medicine. Vaccines are the ultimate justification for the overall “brilliance” of modern medicine.
    Q: Do you believe that people should be allowed to choose whether they should get vaccines?
    A: On a political level, yes. On a scientific level, people need information, so that they can choose well. It’s one thing to say choice is good. But if the atmosphere is full of lies, how can you choose? Also, if the FDA were run by honorable people, these vaccines would not be granted licenses. They would be investigated to within an inch of their lives.
    Q: There are medical historians who state that the overall decline of illnesses was not due to vaccines.
    A: I know. For a long time, I ignored their work.
    Q: Why?
    A: Because I was afraid of what I would find out. I was in the business of developing vaccines. My livelihood depended on continuing that work.
    Q: And then?
    A: I did my own investigation.
    Q: What conclusions did you come to?
    A: The decline of disease is due to improved living conditions.
    Q: What conditions?
    A: Cleaner water. Advanced sewage systems. Nutrition. Fresher food. A decrease in poverty. Germs may be everywhere, but when you are healthy, you don’t contract the diseases as easily.
    Q: What did you feel when you completed your own investigation?
    A: Despair. I realized I was working a sector based on a collection of lies.
    Q: Are some vaccines more dangerous than others?
    A: Yes. The DPT shot, for example. The MMR. But some lots of a vaccine are more dangerous than other lots of the same vaccine. As far as I’m concerned, all vaccines are dangerous.
    Q: Why?
    A: Several reasons. They involve the human immune system in a process that tends to compromise immunity. They can actually cause the disease they are supposed to prevent. They can cause other diseases than the ones they are supposed to prevent.
    Q: Why are we quoted statistics which seem to prove that vaccines have been tremendously successful at wiping out diseases?
    A: Why? To give the illusion that these vaccines are useful. If a vaccine suppresses visible symptoms of a disease like measles, everyone assumes that the vaccine is a success. But, under the surface, the vaccine can harm the immune system itself. And if it causes other diseases — say, meningitis — that fact is masked, because no one believes that the vaccine can do that. The connection is overlooked.
    Q: It is said that the smallpox vaccine wiped out smallpox in England.
    A: Yes. But when you study the available statistics, you get another picture.
    Q: Which is?
    A: There were cities in England where people who were not vaccinated did not get smallpox. There were places where people who were vaccinated experienced smallpox epidemics. And smallpox was already on the decline before the vaccine was introduced.
    Q: So you’re saying that we have been treated to a false history.
    A: Yes. That’s exactly what I’m saying. This is a history that has been cooked up to convince people that vaccines are invariably safe and effective.
    Q: Now, you worked in labs. Where purity was an issue.
    A: The public believes that these labs, these manufacturing facilities are the cleanest places in the world. That is not true. Contamination occurs all the time. You get all sorts of debris introduced into vaccines.
    Q: For example, the SV40 monkey virus slips into the polio vaccine.
    A: Well yes, that happened. But that’s not what I mean. The SV40 got into the polio vaccine because the vaccine was made by using monkey kidneys. But I’m talking about something else. The actual lab conditions. The mistakes. The careless errors. SV40, which was later found in cancer tumors — that was what I would call a structural problem. It was an accepted part of the manufacturing process. If you use monkey kidneys, you open the door to germs which you don’t know are in those kidneys.
    Q: Okay, but let’s ignore that distinction between different types of contaminants for a moment. What contaminants did you find in your many years of work with vaccines?
    A: All right. I’ll give you some of what I came across, and I’ll also give you what colleagues of mine found. Here’s a partial list. In the Rimavex measles vaccine, we found various chicken viruses. In polio vaccine, we found acanthamoeba, which is a so-called “brain-eating” amoeba.
    Simian cytomegalovirus in polio vaccine. Simian foamy virus in the rotavirus vaccine. Bird-cancer viruses in the MMR vaccine. Various micro-organisms in the anthrax vaccine. I’ve found potentially dangerous enzyme inhibitors in several vaccines. Duck, dog, and rabbit viruses in the rubella vaccine. Avian leucosis virus in the flu vaccine. Pestivirus in the MMR vaccine.
    Q: Let me get this straight. These are all contaminants which don’t belong in the vaccines.
    A: That’s right. And if you try to calculate what damage these contaminants can cause, well, we don’t really know, because no testing has been done, or very little testing. It’s a game of roulette. You take your chances. Also, most people don’t know that some polio vaccines, adenovirus vaccines, rubella and hep A and measles vaccines have been made with aborted human fetal tissue. I have found what I believed were bacterial fragments and poliovirus in these vaccines from time to time — which may have come from that fetal tissue. When you look for contaminants in vaccines, you can come up with material that IS puzzling. You know it shouldn’t be there, but you don’t know exactly what you’ve got. I have found what I believed was a very small “fragment” of human hair and also human mucus. I have found what can only be called “foreign protein,” which could mean almost anything. It could mean protein from viruses.
    Q: Alarm bells are ringing all over the place.
    A: How do you think I felt? Remember, this material is going into the bloodstream without passing through some of the ordinary immune defenses.
    Q: How were your findings received?
    A: Basically, it was, don’t worry, this can’t be helped. In making vaccines, you use various animals’ tissue, and that’s where this kind of contamination enters in. Of course, I’m not even mentioning the standard chemicals like formaldehyde, mercury, and aluminum which are purposely put into vaccines.
    Q: This information is pretty staggering.
    A: Yes. And I’m just mentioning some of the biological contaminants. Who knows how many others there are? Others we don’t find because we don’t think to look for them. If tissue from, say, a bird is used to make a vaccine, how many possible germs can be in that tissue? We have no idea. We have no idea what they might be, or what effects they could have on humans.
    Q: And beyond the purity issue?
    A: You are dealing with the basic faulty premise about vaccines. That they intricately stimulate the immune system to create the conditions for immunity from disease. That is the bad premise. It doesn’t work that way. A vaccine is supposed to “create” antibodies which, indirectly, offer protection against disease. However, the immune system is much larger and more involved than antibodies and their related “killer cells.”
    Q: The immune system is?
    A: The entire body, really. Plus the mind. It’s all immune system, you might say. That is why you can have, in the middle of an epidemic, those individuals who remain healthy.
    Q: So the level of general health is important.
    A: More than important. Vital.
    Q: How are vaccine statistics falsely presented?
    A: There are many ways. For example, suppose that 25 people who have received the hepatitis B vaccine come down with hepatitis. Well, hep B is a liver disease. But you can call liver disease many things. You can change the diagnosis. Then, you’ve concealed the root cause of the problem.
    Q: And that happens?
    A: All the time. It HAS to happen, if the doctors automatically assume that people who get vaccines DO NOT come down with the diseases they are now supposed to be protected from. And that is exactly what doctors assume. You see, it’s circular reasoning. It’s a closed system. It admits no fault. No possible fault. If a person who gets a vaccine against hepatitis gets hepatitis, or gets some other disease, the automatic assumption is, this had nothing to do with the disease.
    Q: In your years working in the vaccine establishment, how many doctors did you encounter who admitted that vaccines were a problem?
    A: None. There were a few who privately questioned what they were doing. But they would never go public, even within their companies.
    Q: What was the turning point for you?
    A: I had a friend whose baby died after a DPT shot.
    Q: Did you investigate?
    A: Yes, informally. I found that this baby was completely healthy before the vaccination. There was no reason for his death, except the vaccine. That started my doubts. Of course, I wanted to believe that the baby had gotten a bad shot from a bad lot. But as I looked into this further, I found that was not the case in this instance. I was being drawn into a spiral of doubt that increased over time. I continued to investigate. I found that, contrary to what I thought, vaccines are not tested in a scientific way.
    How Writers Can Sell More Books by Improving Their Public Speaking Skills
    Ester Benjamin Shifren
    Ester Benjamin Shifren, author of the powerful historical memoir, “Hiding in a Cave of Trunks: A Prominent Jewish Family’s Century in Shanghai and Internment in a WWII POW Camp,” will present “How to be a Winning Speaker” at the next monthly meeting of the San Fernando Valley branch of the California Writers Club. The meeting will begin at 1 p.m., on Saturday, April 6 on the Motion Picture and TV Fund campus, 23388 Mulholland Drive in Woodland Hills, in the Saban Community Room.
    It all begins with “keeping the presentation simple, because it’s not an English lesson or smart show-off of ability,” the internationally known Shifren pointed out. “People want to see you and hear you. As the saying goes, it’s all about presentation, and that especially holds true for authors who are trying to publish, sell and publicize their books. Without effective presentation skills, authors will be at a definite disadvantage. The techniques I will teach can also work wonders in individual settings.”
    One of the most glaring mistakes that writers make comes down to the basics. “Anyone who writes a book and doesn’t develop a theme to speak about can say goodbye to the best marketing opportunity,” Shifren said.
    Shifren, also an artist, critic, speaker and entertainer, will explain the do’s and don’ts of effectively communicating with audiences. “It’s important to engage by making occasional eye contact,” she emphasized. “If possible, avoid reading from a scripted lecture. That is a certain way to lose the connection and attention of your audience. Say less if necessary, but make your words count! Use cards with reminders so you won’t forget the essence of your talk. That’s why PowerPoint and Keynote presentations are so valuable!”
    She reminds speakers about another basic that is often forgotten. “It is also very important to smile occasionally, to show you’re human.”
    Though indispensable in this day and age, relying solely on Internet to get the word out is not enough, she said.
    Shifren will ask audience members to write a brief presentation about their book that they can then read aloud to those in attendance. “The brief opening statement should engage the audience immediately and hold their attention. It should be practiced ahead of time – it doesn’t happen by accident,” Shifren added. “The pitch to get gigs should also be practiced until it sounds natural and confident.”
    Before Shifren’s presentation, author Rita Keeley-Brown (“Good Luck Mrs. Brown”) will conduct a 20-minute workshop entitled “Just Write.” Writers will be asked to choose from a series of at least four prompts and are given seven minutes to write a story or poetry. They are then given an opportunity to share their stories/prose with either the persons sitting at the same table or the audience.
    “Memory of a life experience or a thought can be triggered by art, words, smell, or sounds can trigger a recall of something familiar to you,” Brown said. “How many times have you thought or said, “That reminds me of…” and you want to tell someone or write about it?
    “In a nonjudgmental atmosphere, ideas come pouring out. In a group, sharing what you have written is understood by all that this is not a polished write. This is a quick tell of what popped into your mind from that prompt. The comments from reading your rough draft aloud are always encouraging and you get to hear what others wrote – a positive and fun experience.”
    The California Writers Club welcomes writers in all genres, and at all stages of their careers. Monthly meetings are held on the first Saturday. To attend workshops, programs and other events, or to learn more about events and activities for writers in the San Fernando Valley, visit www.cwc-sfv.org. Guests who attend the monthly meeting are asked to donate $10.
    L. Neil Smith’s The Libertarian Enterprise | Novelist Completes 37th and 38th Book!
    0
    L. Neil Smith
    I completed my thirty-seventh and thirty-eighth books, so far,_Only The Young Die Good_ and _Ares_  a few weeks ago, and sent them to my publisher, Shahid Mahmud at Arc Manor/Phoenix Pick. If you’re surprised that I’ve written so many books. imagine how I feel! Interested readers and friends immediately began asking me when they would be published.
    Only The Young Die Good_ is a sequel to my my wonderful little vampire novel, _Sweeter Than Wine_. Both concern the strange adventures of one J. Gifford, a typical  midwestern farmboy and Army Second Lieutenant who survived the D-Day landing and was “brought across” in a hidden wine cellar in wartime France in 1944. He was only 24 years old at the time, and today, he still is, in appearance and physiologically, in 2019.
    The 99-year-old Gifford struggles, despite his “condition”, to bear it ethically and decently. He is aided in this by his cat, Fiddlestring, his best friend, the local police homicide detective, and by his three-hundred-year-old  _inamorata_, Surica Fieraru, the gorgeous redheaded Rumanian resistance fighter pilot who  brought him over in the first place. Together, they confront — and are confronted by — a cast of unexpected and uniquely evil villains (there are worse things in the world than vampires) who threaten to destroy them and the happy life they have built together against the odds.
    Ares_ is the novel I’ve lately been calling “the middle volume of the Ngu Family Saga_”. As you’ll see, that’s not quite correct. _Ares_ is a sequel to my celebrated novel _Pallas_ the story of a young Vietnamese-Cambodian boy, Emerson Ngu, and his struggles on the terraformed asteroid of the novel’s name, to escape collectivism and excel in the wider world of freedom and capitalism. The story follows his life and loves from the age of eight until he is a rejuvenated eighty, and is full of violent adventures and (I hope) inspiring love stories. set in the future, about a century from now.
    Ares_ is also the prequel to _Ceres_, a novel about a young girl, Llyra Ngu, Emerson’s great granddaughter, a Pallatian figure skater whose fondest wish is compete among the champions of Earth. Owing to the gravitational difference, going there straightforwardly would kill her.
    Her journey from Pallas, to Ceres (the asteroid her engineer father is terraforming) to Earth’s Moon, to Mars, and finally to Earth is a fight against the deadly physiological effects of gravity and against the murderous minions of eco-terrorism, as well.
    Ares_ is the story of seventeen-year-old Julie Segovia, a young woman growing up in the poverty-stricken and crime-ridden “vote farms” of Newark, New Jersey. Julie, a currency smuggler, commits an act that is both criminal and necessary and then flees to avoid prosecution. She joins the recruit-hungry East American Marine Corps and eventually gets sent to Mars to help put down a revolt of the colonists — led by Pallatian dissidents, who have begun terraforming Mars in a unique new way — sent there by the East American government and the United Nations.  She meets Billy Ngu, Emerson’s grandson, fights a deadly knife duel with him, and falls in love. I hope you enjoy this novel; for various reasons, it’s taken me sixteen years to write it.
    The _fourth_ book of the Ngu Family “trilogy” will be _Rosalie’s World_. which I have just written the first two happy chapters of. The young ice skater, Llyra Ngu, is now grown up, ‘married with children”, and has taken her charming little family to Earth’s first extra-solar colonial world, an Earthlike planet named after her great grandmother, Rosalie Frazier Ngu. There they face both challenges on an alien planet, and those they inadvertently brought with them.
    I’m also writing, by popular demand, believe it or not,  _The Frozen Stars_ in which Win Bear and his longtime lady-love Healer Clarissa MacDougall, both of them in therapeutic stasis for uncounted years, get a second lease on life with a little help from the unlikeliest aliens you’ve ever heard of.
    I communicated with my esteemed publisher day before yesterday.
    He’s been as busy, so far this year, as a one-handed juggler of chainsaws and bowling balls, but asked me which of the two new novels I wanted to tackle first, publicationwise (I said that, not Shahid). I told him _Ares_. He said, okay, post-production would begin on March 18th. Allowing time for various contingencies, the book will be on sale to you around April 22.
    If you haven’t actually read _Pallas_ yet, now might be a good time to start._Ceres_ comes after _Ares_, and you can read it after that.
    Shahid’s folks and I will go to work on _Only The Young Die Good_ sometime later. I can hardly wait.
