Thousand Oaks, March 4, 2022 – On November 15, former Congressman Elton Gallegly filed a 66-page lawsuit in Ventura County Superior Court for breach of contract against Cal Lutheran University (CLU) for failing to fully establish the Elton and Janice Gallegly Center For Public Service and Civic Engagement. In a short ruling, Ventura County Superior Court Judge Henry Walsh rejected CLU’s effort to dismiss the case.
The former Congressman and his wife raised more than $1 million for the Center. In response to the Court victory, Congressman Gallegly, Ventura County’s longest-serving member in the House of Representatives, issued the following statement.
After CLU approached us to establish the Gallegly Center, Janice and I spent years fundraising for fellowships, archiving, distinguished speaker series and construction of the Gallegly Center. All monies had to be raised before allowing construction to begin on the Gallegly Center. The ruling is an important step in reestablishing the Elton and Janice Gallegly Center for Public Service and Civic Engagement.
The rule of law is a big winner, and the ruling is a significant victory on the road to holding CLU to its agreement with Janice and me to establish the Gallegly Center at the University, which included an exact working replica of my D.C. Congressional Office and the digital archiving of my congressional records.
Editor’s Note: With the ruling that Congressman Gallegly has standing based on his contractual and property interest, the lawsuit against CLU to enforce the charitable trust can proceed, and discovery in the case can continue in earnest.
